In order to fully understand your rights, we encourage you to read this Privacy Policy. We reserve the right to change this Privacy Policy at any time simply by updating this page. Any such change will be effective immediately upon posting, unless otherwise stated. If we make material changes to the way we collect or process personal data, we will let you know by email or by updating this Privacy Policy page. Note however that you are responsible for ensuring we have your up-to-date, active, and deliverable email address and periodically visiting this Privacy Policy page to check for any changes.

This Privacy Policy is hereby incorporated to the TogetheRaise.com Terms of Use. The provisions of the Terms of Use apply to this Privacy Policy. In the event of a conflict between the Terms of Use and this Privacy Policy, this Privacy Policy will govern with respect to the subject matter described herein. Unless otherwise provided herein, all Capitalized terms herein have the same meaning as defined in the Terms of Use.

How We Collect Information and Personal Data


How We Collect Information

We collect information from you whenever you submit information to us, including contacting us, registering an account, making a donation, or otherwise interacting with us or entering information on our website. We also collect certain information automatically when you visit our website, such as IP addresses and data analytics, as further discussed below.


Information Provided By You or Collected From You

We collect information that you provide to us, including personally identifiable information (“PII”) such as your name, email, phone number, postal address, date of birth, personal description, photograph, login credentials to facilitate payment (e.g., PayPal), certain donation information, and other details relevant to your registration and/or use of a TogetheRaise account. We also collect general information you submit such as feedback, comments, questions, or requests through email, our website, or other means.

Note that when you make a donation, you will be prompted to provide your credit card information which goes directly to our payment processing vendor, Stripe, and is not collected, viewed, or stored by TogetheRaise.

We collect certain information automatically from all visitors of our website which helps us improve user experience. We may use computer-based technologies (such as cookies or similar) to automatically collect the Internet Protocol (IP) address used to connect your computer to the Internet, browser type and version, device setting, country location, time zone setting, login status, browsing history on our website - for example, length of visits of a URL, clickstream and mouse-over action, pages abandoned, etc., operating system and platform, and other similar type technical information. We use the data to help diagnose server problems, enhance website functionality, analyze trends, gather broad demographic information for aggregate use (that does not contain PII) to improve our website and services, and for other purposes necessary to providing a safe and secure experience for our users.


Information We May Receive From Other Sources

We use a number of third party providers to host our website and constituent database, maintain data security, process payments, and otherwise administer our services. Those providers may likewise collect information from you that you provide and/or are collected automatically and share this information with us as necessary and appropriate. For example, upon your authorization to the provider, we may receive your payment account identification information, e.g., PayPal, payment activity and status, etc. We endeavor to work with parties with privacy standards that match our own, but in some cases, these parties collect more information on you than we do, and we encourage you to review their privacy policies.

How We Use Information and Personal Data

We only use your information in accordance with the law. This gives us the authority to use your data in relation to your use of our website or participation in our services. We use the collected data for various purposes, including:

  • To render our services, such as facilitating donations;
  • To fulfill any reason you provided the information, including responding to a request or inquiry;
  • To provide information and communicate with our users regarding Campaigns, donations, and our services;
  • To validate your identity for account access, donation processing, Ambassador activities/payments, and/or such other activities requiring additional security measures (all of which may involve use of our third party providers);
  • To create and manage referral connections between you and other users;
  • To notify you about activity related to your account as well as changes to our services, applicable agreements, and policies;
  • To develop our website and services to deliver the content or features in which you are most interested;
  • To detect, prevent, and troubleshoot technical issues;
  • To maintain safety and security in operating our website and services;
  • To make suggestions and recommendations to you about our services that may be of interest to you;
  • To comply with a legal obligation, including ones arising from any agreement between you and TogetheRaise;
  • For any other purpose described in this Privacy Policy; and
  • For any other purpose described to you when collecting your personal information or with your consent.

How We Share Information and Personal Data


We do not sell your information with third parties. However, we may share or disclose your information, including PII, with other pertinent parties as follows:


With Charities.

When you make a donation to a Campaign, we share your personal information with i) our partner, Make My Donation, Inc., a U.S. 501(c)(3) registered public charity which receives and distributes your donation (and who may share such information with its affiliates and vendors to facilitate the distribution) and ii) the designated charity. This is necessary to issue you a valid donation receipt as well for legal compliance purposes.


With a Referrer.

If you make a donation through a Referral Code link, then the underlying TogetheRaise user affiliated with the link (and potentially any higher-level, i.e. upstream, referral user connections related to that specific Referral Link) may be notified with information related to your donation.


With Partners, Vendors, and Subcontractors.

All shared data with third parties is transferred and stored securely, in accordance with the privacy policies of each party.

With Other Users and On Our Website

Information related to your donation may be displayed on our website (for example on the ImpactBoard) and/or included in communication with other users.

On the donation screen, you will have the option to hide public display of your name with respect to your participation in a Campaign (for example, it will not be displayed on our ImpactBoard or shared with any referrer). If you elect that option however, note that your donation information (name, email, donation amount, and time) will still be shared with Make My Donation and the designated charity as described above.

Required/Permitted by Law and With Law Enforcement.

Your information may be shared with others as required by, or permitted by, law. This may include sharing your personally identifiable information with governmental entities or third parties in response to a valid subpoena, court order, other legal process, when reasonably necessary to exercise legal rights, defend against an actual or potential legal claim, or when similarly appropriate to serve the best interests of TogetheRaise and/or our users.

TogetheRaise may report to and share information with law enforcement agencies: i) in relation to any activities that TogetheRaise reasonably believes may be unlawful, ii) to aid a law enforcement investigation into unlawful activity, iii) to reasonably protect the rights and/or safety of any entity (whether TogetheRaise, you, or another person), and/or iv) in relation to a material violation our policies that TogetheRaise reasonably deems as warranting a reporting to law enforcement.

How We Store and Protect Information and Personal Data


Storage of Information

We take commercially reasonable steps to protect your information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information that you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, email may not be secure, and you should, therefore, take special care in deciding what information you send to us via email. To help prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. Our website is scanned by our third party hosting provider on a regular basis for security holes and known vulnerabilities in order to make your visit to our website as safe as possible.

All online donation transactions are handled by Payment Card Industry (PCI)-compliant vendors. PCI refers to the technical and operational standards that businesses must follow to ensure that credit card data provided by cardholders is protected.


Retention of Information and Personal Data

TogetheRaise retains information as necessary and appropriate to comply with all legal, regulatory, tax, audit, and security requirements. All retained information is stored in a secured manner as described above.

How We Communicate with You

TogetheRaise may periodically communicate with you using the contact information provided by you. TogetheRaise may send you security verification requests, e.g., one-time OTP codes to authorize access to your Account, as well as activity updates related to your Account and/or Affiliate Account (for example, including but not limited to donation confirmations, donation receipts, donation activity of other users you refer – directly or indirectly, account balance updates, etc).

CAN-SPAM Act

The Controlling the Assault of Non-Solicited Pornography And Marketing (CAN-SPAM) Act of 2003 (“CAN-SPAM Act”) is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have such emails stopped from being sent to them, and spells out tough penalties for violations. We comply with the CAN-SPAM Act.

We collect your email address in order to:

  • Send information, respond to inquiries, and/or other requests or questions.
  • Send information and updates pertaining to our services.
  • Market to our mailing list or continue to send emails to our registered users and/or interested participants after you have provided us your information.

To be in accordance with the CAN-SPAM Act, we agree to the following for appliable emails:

  • Not use false or misleading subjects or email addresses.
  • Identify an advertising-related message as an advertisement in some reasonable way.
  • Monitor third party email marketing services for compliance, if one is used.
  • Honor opt-out/unsubscribe requests quickly.
  • As required for applicable types of messages, allow users to unsubscribe by using a the link at the bottom of each applicable email.

How We Use Cookies, Tracking, and Personalization


Cookies

A cookie is a small amount of data, which often includes an anonymous unique identifier that is sent to your browser from a website’s servers and stored on your computer. We use cookies (and similar technologies) on our website for essential purposes (that is, required for the basic functioning of the website). Analytics data gathered via cookie or similar is in a user-anonymized, aggregate manner (with no personally identifiable information) in support of such purposes. This website does not contain cookies for purposes of advertising on the website, or content personalization. Some of our third party providers may also use cookies and/or tokens (such as when you engage with payment mechanisms, including Stripe and/or PayPal). Turning Off Cookies

You have the right to turn off cookies. You may disable cookies by adjusting the settings of your web browser. Please note however that if you limit and/or turn off cookies, that you may not be able to access or utilize some or all portions of the TogetheRaise website and the Services.


Personalization

We customize your experience on this website (and in our communications to you) based on your i) creating an account (a User Account and/or an Affiliate Account) and utilizing the website as a logged-in user and/or ii) making a donation to a Campaign; otherwise, TogetheRaise does not to build personalize profiles about you or deliver personalized content to you.


Tracking

TogetheRaise does not track your browsing behavior outside of using our website, other than when you are routed to our website from another party’s, and vice versa.


No Advertising or Sale Of Information

TogetheRaise does not include advertising on our website.

TogetheRaise does not sell or trade for value any information about you to third parties.

External Distribution of Information, Links, and User Connections

The information displayed on our website, including your information, may be crawled by third parties and displayed on third party websites, such as Google.

Our users may post Referral Links or other information provided by us as described above, on websites and platforms outside of TogetheRaise. If you engage these links/referrals, depending on your actions, a publicly visible connection between you and the underlying TogetheRaise user affiliated with the link may be displayed on TogetheRaise. Particularly, if you make a donation through another user’s Referral Link, your information and donation (including donation amount) will be displayed as attributable to that other user.

Even if you elect not to display your personal information when donating to a Campaign, the amount donated may still be displayed, and others may be able to infer your identity based on the connection between the anonymous donation and affiliated users.

You acknowledge and agree that by using TogetheRaise your connections to other users may be directly visible or may be inferred by others, and you will not submit any personal information to TogetheRaise if you do not approve of such use of your information.


Links to Third Party Websites/Services

We may display links to websites of our third party service providers. These websites have separate and independent privacy policies. We take no responsibility or liability for the content and activities of the linked websites. Nonetheless, we seek to protect our integrity and welcome any feedback about these websites.

Managing Your Account or Information


Access

You can view and manage your account information (including any details as may be related to your Ambassador Account) by logging in to your account on the website.

You may also request that we disclose certain information to you about our collection and use of your personal information pursuant to your legal rights under applicable privacy laws. We may need to confirm your identity prior to disclosing the information.


Display

In the event you do not wish for your name to be displayed on the TogetheRaise website, please select the option at the time of donation for your information not to be displayed on the ImpactBoard (or if after the fact, email your request to “support@togetheraise.com”). Your donation amount (without any personally identifiable information) information may be displayed on the website, in the applicable referral tree, even if you elect for your name information not to be displayed.


Deletions

You may request to delete any of your personal information that we collected from you and retained pursuant to your legal rights under applicable privacy laws, subject to certain exceptions. Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service providers to (i) complete the transaction for which we collected personal information, such as processing your donation, (ii) comply with a legal obligation, or (ii) or as otherwise provided herein. Due to regulatory, tax, and audit requirements, we must retain certain donation information, including donor name, amount, Tip amount, and its location in a referral tree. For this reason, we may deny your request to delete such information.

You acknowledge and agree that certain information related to any Donation may be retained by either us or the applicable third party even after a deletion request by you, and you will not submit any personal information to TogetheRaise if you do not approve of such potential retention of your information.

Children’s Privacy

TogetheRaise does not knowingly collect, use, store, display, share, or disclose personally identifiable information about users younger than 13 years of age.

If you are under the age of 13, you are prohibited from accessing the website or making a donation.

If you are the parent or guardian of a child under 13 years of age and believe that they have disclosed personally identifiable information, in order to enable us to delete your child’s information, please contact us at: “support@togetheraise.com”.
